Last updated: 25 February 2026 . Effective for: Visitors and clients of delaeMD (the “Company”, “we”, “us”, or “our”) — an executive health and longevity medicine provider operating in California.

1. Acceptance of Terms and Definitions

1.1 Agreement By accessing or using our website, platform, and clinical services (collectively, the Services), you agree to these Terms of Service (Terms) and any documents expressly incorporated by reference. If you do not agree, do not use the Services.

1.2 Definitions

  • Client or You means any individual who registers for, purchases, or uses the Services.

  • Program means any multi‑visit, subscription, or bundled longevity plan or coaching package.

  • Consultation means any scheduled clinical encounter, virtual or in‑person, between you and our clinicians.

  • Platform means our website, patient portal, mobile applications, and any related software.

2. Scope of Services and Eligibility

2.1 Scope of Services We provide personalized executive health assessments, preventive and longevity medicine consultations, diagnostic testing coordination, health optimization plans, and related non‑emergency clinical services. We do not provide emergency care or urgent out‑of‑hours services.

2.2 Eligibility You must be at least 18 years old and legally able to consent to medical care in California. You are responsible for maintaining a primary care relationship for routine and emergency care unless otherwise agreed in writing.

2.3 Third Party Services Certain diagnostics, imaging, laboratory testing, or specialist referrals may be provided by third parties and are subject to their terms, fees, and privacy practices.

3. Appointment Cancellations and No Shows 

3.1 Booking Appointments are scheduled through our Platform or by contacting our care team. You must provide accurate contact and health information.

3.2 Cancellation Policy delaeMD does not charge cancellation fees. You may cancel or reschedule appointments through the Platform or by contacting our care team. While we do not charge a fee, repeated late cancellations or no‑shows may result in limitations on future scheduling or discontinuation of Services at our discretion.

3.3 Diagnostic Kits and Third Party Tests Orders for diagnostic kits or third party tests may be non‑refundable once dispatched or processed. Specific terms will be provided at the time of purchase.

4. Fee Payments and Insurance 

4.1 Fees Fees for Services are set forth on our Platform, in program materials, or in your client agreement. We may require payment in full, a deposit, or a subscription authorization prior to delivering Services.

4.2 Payment Methods We accept the payment methods displayed at checkout. By providing a payment method you authorize us to charge for Services, recurring program fees, and applicable taxes.

4.3 Insurance Our Services are primarily private pay. We do not guarantee coverage or reimbursement by any insurer. It is your responsibility to verify coverage and seek reimbursement from your insurer where applicable.

4.4 Late or Failed Payments We reserve the right to suspend Services for overdue accounts and to recover collection costs and reasonable legal fees.

5. Clinical Terms, Data Privacy, and Intellectual Property 

5.1 Clinical Care and Consent All clinical care is provided by licensed clinicians in accordance with professional standards. Recommendations are individualized and do not guarantee specific longevity outcomes. You must provide informed consent for assessments, tests, and treatments and disclose accurate medical history, medications, and allergies.

5.2 Telemedicine Telemedicine consultations have limitations compared with in‑person visits. If a clinician determines an in‑person assessment or urgent care is required, they will advise you.

5.3 Medical Records We maintain clinical records in accordance with applicable law. You may request access to your records as described in our privacy documentation.

5.4 Privacy Summary We currently do not have a published Privacy Policy on the Platform. Until a full Privacy Policy is posted, you should assume:

  • We collect personal and health information necessary to provide clinical care and operate the Platform.

  • We use data to deliver Services, coordinate care, process payments, and for quality improvement and aggregated research with appropriate safeguards.

  • We share information with third party labs, imaging centers, and service providers as necessary to deliver Services.

  • We protect data with reasonable administrative, technical, and physical safeguards but cannot guarantee absolute security.

A complete Privacy Policy describing data collection, use, retention, access, and your rights will be posted and linked from the Platform as soon as available. By using the Services you consent to the collection and use described above and in the forthcoming Privacy Policy.

5.5 Intellectual Property All content on the Platform including text, graphics, logos, and software is owned or licensed by delaeMD. You may not reproduce, distribute, or create derivative works without our written permission.

6. User Responsibilities Conduct Termination Liability and Governing Law

6.1 User Responsibilities You must provide truthful, complete, and up‑to‑date information. Misrepresentation may compromise care and may be grounds for termination of Services.

6.2 Conduct You agree to treat staff and clinicians with respect. Harassment, threats, or abusive behavior may result in immediate termination of Services.

6.3 Termination and Suspension We may suspend or terminate Services for breach of these Terms, non‑payment, or where continued care is clinically inappropriate. You may cancel subscriptions or programs in accordance with the terms provided at purchase. Termination does not relieve you of outstanding payment obligations.

6.4 Limitation of Liability To the fullest extent permitted by law, our liability for direct damages arising from Services is limited to the amount you paid for the Services in the 12 months preceding the claim. We are not liable for indirect, incidental, consequential, or punitive damages.

6.5 Indemnification You agree to indemnify and hold delaeMD and its affiliates harmless from claims arising from your breach of these Terms or misuse of the Services.

6.6 Governing Law and Dispute Resolution These Terms are governed by the laws of the State of California. Any disputes will be resolved in the state or federal courts located in California unless otherwise agreed in writing. Certain disputes may be subject to arbitration as set out in your client agreement.
